1. About PartyNow

PartyNow is an AI-powered nightlife discovery platform that connects event seekers with parties, clubs, and events happening in their city. We also provide event organizers and promoters with tools to promote events through our advertising platform.

2. Account Types and Services

2.1 Event Seekers (Free Users)

As an event seeker, you can:
- Browse and search for events in your area
- Use AI-powered recommendations and the "Tonight For Me" swipe feature
- View the live heat map and real-time Vibe Scores
- Bookmark events and receive notifications
- Filter events by genre, price, date, location, and venue type
- Access all core features free of charge

2.2 Event Organizers and Promoters

As an event organizer, you can:
- Submit events for review and publication (free)
- Edit your event listings
- View basic analytics for your events
- Purchase advertising campaigns to promote your events (paid)

2.3 Advertisers

As an advertiser, you can:
- Create and manage advertising campaigns
- Purchase sponsored listings, featured events, push notifications, and banner ads
- Access detailed analytics and targeting options
- Set daily budgets and control spending

3. User Accounts and Eligibility

3.1 Age Requirement

You must be at least 18 years old to use PartyNow. By creating an account, you represent that you meet this age requirement.

3.2 Account Registration

To access certain features, you must create an account with accurate information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access

3.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the Platform.

4. User Conduct and Prohibited Activities

You agree NOT to:

- Attempt to hack, breach security, or reverse engineer the Platform
- Upload malware, viruses, or malicious code
- Spam users with unsolicited messages or content
- Create multiple accounts to manipulate Vibe Scores or engagement metrics

4.3 Content Guidelines
- Post content that is discriminatory, hateful, or promotes violence
- Share sexually explicit content outside of age-appropriate event contexts
- Violate intellectual property rights of others
- Harass, bully, or threaten other users

Violations may result in content removal, account suspension, or permanent ban.

5. Event Submissions and Content

5.1 Event Review Process

All submitted events are reviewed by our team (typically within 24 hours) to ensure they meet quality standards and comply with our guidelines. We reserve the right to:
- Reject events that don't meet our standards
- Edit event details for clarity or compliance
- Remove events that violate these Terms or receive complaints

5.2 Content Ownership

Event organizers retain ownership of their event content (descriptions, photos, etc.) but grant PartyNow a worldwide, non-exclusive, royalty-free license to:
- Display events on the Platform
- Use event content in marketing materials, heat maps, and recommendations
- Share event information with users through notifications and promotions

5.3 Content Removal

Event organizers can remove their events at any time. However, archived data and analytics may be retained for business records.

6. Advertising Services and Payments

6.1 Campaign Creation

Advertisers can create campaigns with:
- Custom budgets (daily spending limits)
- Audience targeting (location, demographics, preferences, behavior)
- Multiple campaign types (sponsored listings, featured events, push notifications, banners)

6.2 Payment Terms

- Payments are processed securely through Stripe
- Pay-per-click pricing: You are charged only when users engage with your ads
- Daily budgets: Spending stops automatically when your daily limit is reached
- No minimum spend: Start with any budget and scale as needed

6.3 Campaign Performance

- We provide transparent analytics but do not guarantee specific results
- Impressions, clicks, and conversions may vary based on competition, timing, and targeting
- Campaign approval is at our discretion
- We may pause or reject campaigns that violate our advertising policies

6.4 Refund Policy

Advertising payments are generally non-refundable. However, we may offer refunds or credits at our discretion for:
- Technical issues preventing campaign delivery
- Billing errors or duplicate charges
- Campaigns paused by us due to policy violations (pro-rated refunds)

Refund requests must be submitted within 7 days of the charge.

7. Vibe Scores and Engagement Metrics

7.1 How Vibe Scores Work

Vibe Scores (0-100) are calculated based on real user engagement including bookmarks, shares, views, and click-through rates. These scores are dynamic and update in real-time.

7.2 Prohibited Manipulation

You may NOT:
- Create fake accounts to artificially inflate Vibe Scores
- Use bots or automated tools to generate fake engagement
- Pay third parties to artificially boost your event's metrics
- Coordinate artificial engagement campaigns

Violations will result in event removal and potential account ban.

8. Intellectual Property

8.1 PartyNow's Property

The Platform, including its design, features, algorithms, code, branding, and content (excluding user submissions), is owned by PartyNow and protected by intellectual property laws. You may not:
- Copy, modify, or create derivative works
- Reverse engineer or decompile the Platform
- Use our trademarks or branding without permission

8.2 User Content

By submitting content (events, photos, descriptions), you represent that:
- You own or have rights to use the content
- The content does not violate any third-party rights
- You grant us the license described in Section 5.2

9. Location Services and Notifications

9.1 Location Data

Location services are optional but required for certain features (heat map, nearby events, location-based notifications). You can control location permissions in your device settings.

9.2 Push Notifications

By enabling notifications, you consent to receive:
- Event reminders for bookmarked events
- Alerts about nearby trending events
- Personalized weekend recommendations
- Campaign notifications from advertisers (if targeted to you)

You can disable notifications anytime in your account settings.

10. Third-Party Services

PartyNow integrates with third-party services including:
- Google OAuth for authentication
- Stripe for payment processing
- OpenAI for AI-powered recommendations
- Resend for email delivery

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service failures or issues.

11. Disclaimers and Limitations

11.1 Platform Availability

PartyNow is provided "as is" without warranties of any kind. We do not guarantee:
- Uninterrupted or error-free service
- Accuracy of event information submitted by organizers
- Specific results from advertising campaigns
- Security against all potential threats

11.2 Event Accuracy

Event information is provided by organizers. We are not responsible for:
- Cancelled, postponed, or changed events
- Inaccurate pricing, dates, or venue information
- Event quality or safety
- Disputes between users and event organizers

We recommend verifying event details with organizers before attending.

11.3 User Interactions

PartyNow is a platform connecting users and organizers. We are not responsible for:
- User conduct at events
- Disputes between users
- Safety or security at venues
- Quality of events or experiences

12. Limitation of Liability

To the fullest extent permitted by law:

- Our total liability shall not exceed $100 or the amount you paid us in the last 12 months (whichever is greater)
- We are not liable for indirect, incidental, consequential, or punitive damages
- We are not liable for loss of profits, data, or business opportunities

13. Indemnification

You agree to indemnify and hold PartyNow harmless from claims, damages, and expenses (including legal fees) arising from:
- Your violation of these Terms
- Your content or event submissions
- Your use or misuse of the Platform
- Your violation of third-party rights

14. Data and Privacy

Your use of PartyNow is subject to our Privacy Policy at https://partynow.top/privacy-policy. By using the Platform, you consent to our data practices as described in the Privacy Policy.

- We collect personal data (name, email, location, preferences)

15. Dispute Resolution

- Outstanding advertising balances are forfeited (no refunds)
- Your content may be removed (though analytics may be retained)

18. Miscellaneous

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PartyNow regarding use of the Platform.

18.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect.

18.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

18.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign our rights and obligations without restriction.
